These Terms govern

  • any other related Agreement or legal relationship with the Owner
in a legally binding way. Capitalized words are defined in the relevant dedicated section of this document.

PHOTOS/VIDEOS POLICY
OWN Academy Limited may use media content (recorded videos, photos, and other visual or audio materials) taken during OWN Academy’s activities in promotional and advertising materials and on our website. If you would like your child to opt out of this photo and video policy, please email us at [email protected]. Please note that these photos/videos will not be passed on to third parties without additional written consent, and the names and identities of the child will never be disclosed.

GENERAL TERMS AND CONDITIONS

  1. POLICIES & GUIDELINES
    a) By enrolling my child in OWN Education Limited (“OWN”) courses I agree that my child will abide by the policies and guidelines set out by the company.
    b) I will not hold OWN responsible for any injury to my child, or damage or loss to my property as a result of participation in these courses.
  2. WEATHER POLICY
    a) Please note that in the event of event space closure, or, due to inclement weather, such as heavy rain or typhoon, in order to ensure safety of students in the venues where our programmes are delivered, classes/sports sessions will be canceled and no make-up, refund or credit note will be issued.
  3. PHOTO / VIDEO POLICY
    a) ESL may use photos/videos taken during ESL’s activities in promotional and advertising materials and on our website.
    b) Please see Photo/Video policy for full details. 
  4. COLLECTION OF PERSONAL INFORMATION
    a) The information submitted during the application process is being collected in accordance with the OWN Academy Data Handling Policy and its related Personal Information Collection Statements (“PICS”).

PROGRAM TERMS AND CONDITIONS

  1. PARTICIPATION
    A student must complete the pre-program survey to confirm their registration seats. A student must also complete the post-program survey to claim their certificate of attendance for this program.
  2. REFUNDS
    Program fee is non-refundable.
    We regret that we cannot, under any circumstances, give refunds for services & classes already paid for, except in the event of cessation of a program after its commencement. We will refund to students the course fee on a pro-rata basis within 30 days after the cessation of the program.
  3. MAKE-UP CLASSES
    No make-up class is available for classes.

LIABILITY AND WAIVER

OWN ACADEMY AGREEMENT AND LIABILITY WAIVER (”Agreement and Waiver”) 

PLEASE READ THE FOLLOWING AGREEMENT AND WAIVER CAREFULLY, AS IT AFFECTS YOUR FUTURE LEGAL RIGHTS. BY PROCEEDING WITH REGISTERING FOR THE EVENT, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE CAREFULLY READ THE AGREEMENT AND WAIVER AND AGREE TO THE TERMS SET FORTH BELOW.

Though you still need to read the entire document, some of the key points of this Agreement and Waiver are highlighted here:

  • The activity for which you are registering (the ”Event”) may be physically challenging and pose a risk of discomfort, illness, injury, and even death. It is your responsibility to ensure that you are in sufficient physical condition to participate in the Event without risk to your health or your life. We do not conduct health or fitness checks on entrants.
  • Some Events may pose certain risks to participants and observers. We cannot remove risks to participants and observers and, accordingly, you participate and/or observe at your own risk.
  • Where you have registered or entered on behalf of anyone under the age of 18 or have accompanied anyone under the age of 18 to observe the Event, you also agree to the contents of this Agreement and Waiver on behalf of the person under 18.

In consideration of being permitted to register and/or participate in and/or observe the Event, on behalf of yourself and any personal representatives, assigns, heirs, executors, successors, next of kin, and persons supported by you (if relevant under the applicable laws), you understand that:

  1. Authority to Register and/or to Act as Agent. You represent and warrant to OWN Education Limited (”OWN”) that you have full legal authority and capacity to complete the registration for the Event, including this Agreement and Waiver, on behalf of yourself and/or, where applicable, any party for whom you are registering (the ”Registered Parties”), including full authority to make use of the credit or debit card to which registration fees will be charged. As used in this Agreement and Waiver, (a) ”OWN” means and includes OWN Education Limited, its partners, licensors, and any and all subsidiaries, affiliated entities, or entities that control, are controlled by, or are under common control with OWN singly or together and its and each of their officers, employees, contractors, subcontractors and agents and each of their agents, representatives, successors and assigns; and (b) ”you” or ”your” means and includes you (as an individual) and all other Registered Parties for whom you are registering, and by virtue of agreeing to this Agreement and Waiver, for whom you are waiving certain rights.

    If you are registering a child under the age of 18 or an incapacitated adult, you represent and warrant that you are the parent or legal guardian of that party and have the legal authority and capacity to enter into this Agreement and Waiver on his/her behalf and by proceeding with registration for the Event, you agree that the terms of this Agreement and Waiver shall apply equally to all of the Registered Parties. To the extent permitted by law, each person agreeing to this Agreement and Waiver for him/herself and/or on behalf of another Registered Party (including, without limitation, any minor) agrees to indemnify, defend, and hold OWN harmless from any liability, claim, demand, cause of action, damage, loss, or expense (including court costs and reasonable attorneys’s fees) of any kind or nature (each, a ”Liability” and collectively ”Liabilities”) in the event the Liability arises because a Registered Party is found by a court of competent jurisdiction to not be bound by the terms and conditions of this this Agreement and Waiver. In addition, if, despite this Agreement and Waiver, any of the Registered Parties makes a claim against OWN, you agree, immediately upon request or demand by OWN, to defend, indemnify, and hold OWN harmless from all Liabilities which may be incurred as the result of such claim.

  1. ASSUMPTION OF RISK. IN CONSIDERATION OF THE ACCEPTANCE OF YOUR REGISTRATION AND PARTICIPATION IN THE EVENT, YOU ASSUME FULL AND COMPLETE RISK AND RESPONSIBILITY FOR ANY DISCOMFORT, ILLNESS, INJURY, OR ACCIDENT WHICH MAY OCCUR WHILE YOU ARE PREPARING FOR THE EVENT, DURING THE EVENT, WHILE YOU ARE ON THE PREMISES OF THE EVENT, OR WHILE YOU ARE TRAVELING TO OR FROM THE EVENT. YOU UNDERSTAND THAT, DEPENDING ON THE NATURE OF THE EVENT, PARTICIPATING IN THE EVENT MAY BE HAZARDOUS, AND THAT YOU SHOULD NOT ENTER AND PARTICIPATE UNLESS YOU ARE IN SUFFICIENT PHYSICAL CONDITION TO PARTICIPATE. IF NEEDED, YOU SHOULD CONSULT YOUR DOCTOR BEFORE PARTICIPATING IN THE EVENT. IF APPLICABLE, YOU ACKNOWLEDGE AND AGREE THAT THE EVENT MAY BE HELD OVER PUBLIC ROADS AND FACILITIES OPEN TO THE PUBLIC DURING THE EVENT AND UPON WHICH HAZARDS ARE TO BE EXPECTED. YOU ALSO ACKNOWLEDGE AND AGREE THAT PARTICIPATION IN THE EVENT MAY CARRY WITH IT CERTAIN INHERENT RISKS AND DANGERS THAT CANNOT BE ELIMINATED COMPLETELY RANGING FROM RISK OF MINOR DISCOMFORT TO CATASTROPHIC INJURIES INCLUDING PERMANENT DISABILITY AND DEATH. YOU ARE AWARE OF AND ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATING IN THE EVENT, INCLUDING, WITHOUT LIMITATION, RISKS OF PERMANENT INJURY OR DEATH DUE TO FALLS, OBSTACLES, CONTACT WITH OTHER PARTICIPANTS, ACTS OR OMISSIONS OF OTHER PARTICIPANTS, EFFECT OF WEATHER, TRAFFIC AND CONDITIONS OF ANY ROAD.
  1. Representations. You represent and warrant that you are in sufficient physical condition to safely participate in the Event, and have no medical condition that would make your participation in the Event more hazardous. You consent to medical care and transportation in order to obtain treatment in the event of injury to you and understand that this Agreement and Waiver extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury. You understand that no medical care may be available, but if it is, you assume liability for any and all medical expenses incurred as a result of your participation in the Event (where such medical expenses are not provided on a free of charge basis by any medical services organizations, clinics, or hospitals), including, but not limited to ambulance transport, hospital stays, physician, and pharmaceutical goods and services. You agree to observe and obey all posted rules and warnings, to follow any instructions or directions provided to you by OWN or the Event organizer and to abide by any decision of any Event official relative to your ability to safely participate in or attend the Event. You understand and agree that you are expected to exhibit appropriate behavior at all times while at the Event and to obey all applicable laws while participating in or attending the Event. This includes, generally, respect for other people, equipment, facilities or property. You agree that Event officials may dismiss you, without refund, should your behavior, in the opinion of OWN or the Event organizer, endanger the safety of or negatively affect the Event. You understand and agree that you are responsible for taking care of your own personal belongings during the Event and, to the maximum extent permitted by law, neither OWN nor the Event organizer is responsible for any personal item or property that is lost, damaged or stolen at the Event. You understand and agree that the Event organizer reserves the right to cancel the Event in the event of weather (including, but not limited to, heat, tornadoes, earthquakes, fires, storms, lightning and floods), accidents, acts of war or terrorism, military conflicts or riots, or for any reason that would affect the safety and security of Event participants and/or spectators or the feasibility of the Event to be held. In the event of such cancellation or any other cancellation for any reason, there will be no refund of your payment unless authorized and paid by the Event organizer.
  1. RELEASE AND WAIVER OF LIABILITY. YOU HEREBY WAIVE, RELEASE, COVENANT NOT TO SUE AND FOREVER DISCHARGE OWN AND ALL OTHER PERSONS ASSOCIATED WITH THE EVENT, FOR ALL LIABILITIES, CLAIMS, ACTIONS, OR DAMAGES THAT YOU MAY HAVE AGAINST THEM ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR REGISTRATION AND/OR PARTICIPATION IN THE EVENT, INCLUDING WITHOUT LIMITATION ANY LIABILITIES, CLAIMS, ACTIONS, OR DAMAGES CAUSED BY NEGLIGENCE OF THE ABOVE PARTIES (INCLUDING ANY NEGLIGENT RESCUE ATTEMPT), THE ACTION OR INACTION OF ANY OF THE ABOVE PARTIES, OR OTHERWISE.

    OWN SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF OWN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). WITHOUT LIMITING THE FOREGOING, OWN WILL NOT BE RESPONSIBLE FOR (A) THE USE OR THE INABILITY TO USE THE OWN SITES, PRODUCTS OR SERVICES; (B) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE OWN SITES; (C) YOUR PARTICIPATION IN ANY PROMOTION OR PROGRAM COORDINATED BY OWN; (D) PERSONAL INJURY; (E) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (F) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE OWN SITES; (G) ANY OTHER MATTER RELATING TO THE OWN SITES, OR OWN PRODUCTS OR SERVICES; OR (H) YOUR PARTICIPATION IN THE EVENT. YOU AGREE THAT OWN’S MAXIMUM LIABILITY TO YOU, FOR ANY REASON OR CAUSE WHATSOEVER, SHALL NOT EXCEED THE TOTAL AMOUNT OF MONIES RECEIVED BY OWN FROM YOU.
    NOTHING IN THIS AGREEMENT AND WAIVER SHALL BE CONSTRUED AS LIMITING OR EXCLUDING OWNS OR THE EVENT ORGANIZER’S LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER MATTER FOR WHICH IT WOULD BE ILLEGAL OR UNLAWFUL TO EXCLUDE OR ATTEMPT TO EXCLUDE LIABILITY. YOUR STATUTORY RIGHTS AS A CONSUMER ARE NOT AFFECTED BY THIS AGREEMENT AND WAIVER.

  1. INDEMNITY. YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS OWN AND ALL OTHER PERSONS ASSOCIATED WITH THE EVENT, FROM ALL LIABILITIES ARISING OUT OF OR IN ANY WAY CONNECTED WITH (A) YOUR PARTICIPATION IN THE EVENT, INCLUDING WITHOUT LIMITATION ANY LIABILITY CAUSED BY NEGLIGENCE (INCLUDING ANY NEGLIGENT RESCUE ATTEMPT), THE ACTION OR INACTION OF OWN, (B) YOUR USE OF OWN, OR (C) ANY VIOLATION BY YOU OF ANY TERMS OF THIS AGREEMENT AND WAIVER AND/OR THE TERMS OF SERVICE LOCATED AT https://ownacademy.co/terms-and-conditions/
  1. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF OWN’S SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN ”AS IS” AND ”AS AVAILABLE” BASIS. OWN MAKES NO WARRANTY THAT OWN SITES’ SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE. OWN EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. OWN DOES NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY INFORMATION ON, OR PROVIDED IN CONNECTION WITH, THE OWN SITES. OWN IS NOT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS, OR FOR THE RESULTS OBTAINED FROM THE USE OF SUCH INFORMATION.
  1. Severability. You further expressly agree that this Agreement and Waiver is intended to be as broad and inclusive as is permitted by applicable law, and if any provision of this Agreement and Waiver is held to be unenforceable by a court of competent jurisdiction for any reason whatsoever, (a) the validity, legality, and enforceability of the remaining provisions of this Agreement and Waiver (including without limitation, all portions of any provisions containing any such unenforceable provision that are not themselves unenforceable) shall not in any way be affected or impaired thereby, and (b) to the fullest extent possible, the unenforceable provision shall be deemed modified and replaced by a provision that approximates the intent and economic effect of the unenforceable provision and the Agreement and Waiver shall be deemed amended accordingly.
  1. ACCEPTANCE. BY INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT AND WAIVER, YOU ARE AFFIRMING THAT YOU HAVE READ THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS. YOU UNDERSTAND THAT YOU AND ALL REGISTERED PARTIES ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ACKNOWLEDGE THAT YOU ARE AGREEING TO THIS AGREEMENT AND WAIVER FREELY AND VOLUNTARILY, AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. IF THE PARTICIPANT IS A MINOR OR INCAPACITATED ADULT, YOU CERTIFY THAT YOU ARE THE PARTICIPANT’S PARENT OR GUARDIAN AND AGREE TO THIS WAIVER AND RELEASE FROM LIABILITY ON BEHALF OF THE PARTICIPANT.
  2.  Applicable Law; Consent to Jurisdiction; Other Jurisdiction-Specific Provisions. Provisions Applicable to Events Held in Hong Kong: You agree that the laws of Hong Kong will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with OWN relating to this Agreement and Waiver shall be the courts of Hong Kong.

    You irrevocably grant OWN and the Event organizer permission to exhibit, edit, circulate, publish and use your personal data (as defined in the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong)).
    Provisions Applicable to Events Held in Singapore: You agree that the laws of Singapore will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with OWN relating to this Agreement and Waiver shall be the courts of the Republic of Singapore.

Privacy Policy

OWN Education Limited (OWN Academy) offers to its users a range of online and offline programs and operates the ‘https://ownacademy.co/’ website. We provide programs and services for schools and youth aged 10 and above, while others are intended for users of all ages and their families. 
This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our service and the choices you have associated with that data.
We use your data to provide and improve our programs and services. By engaging with our programs and services, you agree to the collection and use of information in accordance with this policy.

Information Collection and Use
We collect several different types of information for various purposes to provide and improve our programs and services to you.

1. Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

This may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

OWN Academy uses the collected data for various purposes:

  • To understand you or your child so we can provide a more personalized learning experience and help with career life planning
  • To provide and maintain our programs and services
  • To notify you about changes to our programs and services
  • To provide customer support
  • To gather analysis or valuable information so that we can improve our programs and services
  • To monitor the usage of our programs and services
  • To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information
  • Photographs and videos might be used for marketing purposes such as publicising or promoting our programs and services and the students’ accomplishments on OWN Academy’s websites, social media promotions etc. or on our partners’ websites

OWN Academy will not transfer your Personal Data to any party outside of its business. However, if it is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Legal Basis for Processing Personal Data

OWN Academy may process your Personal Data because:

  • You have given us permission to do so
  • The processing is in our legitimate interests and is not overridden by your rights
  • For payment processing purposes
  • To comply with the law

Retention of Data

OWN Academy will retain your Personal Data only for as long as is necessary due to the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. The security of your data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

We may employ third party companies and individuals to facilitate our programs and services, to provide the programs and services on our behalf, or to assist us in analyzing how our programs and services are used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

  • Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.   • HubSpot is an inbound marketing and sales software that helps companies attract visitors, convert leads, and close customers. Payments

We may provide paid programs and services. In that case, we use third-party services for payment processing (e.g. payment processors).

Child Protection Policy

A ‘Child’ or ‘Children’ is hereby defined as a person under the age of 18 years old.

OWN Education Limited (OWN Academy) will protect the rights of children, in line with the UN Convention on the Rights of the Child; and/or national legislation in the country of operations, whichever standard is higher.

We commit to child safeguarding: to prevent, deter, detect and respond to potential harm (physical, psychological) in all OWN activities, including but not limited to OWN programs, events, social media engagement, and staff interactions with children.

OWN Academy will hold our contracting parties (e.g., implementing partners, service providers, third parties, volunteers) to the same standard.

Code of Conduct for Engaging Children

Industry professionals, contracting parties must:

  • Complete and update their sexual conviction or criminal record check before any engagement with a child.  
  • Commit to create a culture of openness and mutual accountability. This culture will enable all child protection concerns to be raised and discussed and abusive behaviour can and must be challenged. 
  • Contribute to an environment where children are listened to and respected as individuals and that which is safe, positive and encouraging to them.
  • For offline engagement,
    • ensure that each room has at least 2 participants other than the instructor.
    • ensure physical contact is at all times appropriate and not an invasion of the child’s privacy.
  • For online engagement, 
    • ensure that each room has at least 2 participants other than the instructor.
    • ensure that the session is recorded for OWN’s keepsake. 
  • Use positive, non-violent methods to manage children’s behaviour. 
  • Not take photos or videos of children without seeking prior written permission from OWN.
  • Restrain from publishing photos or videos taken at OWN’s events without seeking prior written permission from OWN.
  • Not give / collect personal information to / from the child.

 

Children’s Online Privacy Policy

OWN Academy offers to its users a range of online and offline programs primarily targeted at youth age 13 and above, while others are intended for users of all ages and their families. Such activities that may collect information from children. 

Below we summarize potential instances of data collection and outline how and when we will provide parental notice and/or seek parental consent. The following will prevail those of page 2 – 5 of this agreement should there be any inconsistencies with regards to the collection and use of a child’s personal information, and that only applies to a person under the age of 18 years old. 

Registration

During the registration process, we may ask the child to provide certain information for notification and security purposes, including a parent or guardian’s email address, the child’s first name and gender. We also may ask for the birth year from children to validate their ages. 

About the collection of parent email addresses: in any instance where we ask for age and determine the user is age 12 and/or under, we will ask for a parent or guardian email address before we collect any personal information from the child. If you believe your child is participating in an activity that collects personal information and you or another parent/guardian have NOT received an email providing notice or seeking your consent, please feel free to contact us at [email protected]

Pre / Post Program Surveys and Email Contact with a Child

In connection with OWN’s mission to create a shared community and journey to personal and professional growth, we may collect a child’s online contact information, such as but not limited to an email address, in order to communicate with the child more than once. In such instances we will retain the child’s online contact information to honor our mission. Whenever we collect a child’s online contact information for ongoing communications, we will simultaneously require a parent email address in order to notify the parent about the collection and use of the child’s information, as well as to provide the parent an opportunity to prevent further contact with the child. On some occasions a child may be engaged in more than one ongoing communication, and a parent may be required to “opt-out” of each communication individually. Please refer to the Letter to Parents for more information. 

Parental Email Consent

In the event OWN wishes to collect personal information from a child, we first seek a parent or guardian’s consent by email or via his or her school. We will explain what information we are collecting, how we plan to use it, how the parent can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent contact information and any other information collected from the child in connection with that activity, after the activity has ended.

Content Generated by a Child

Certain activities allow children to create or repurpose content and save it with OWN. Some of these activities do not require children to provide any personal information and therefore may not result in notice to the parent or require parental consent. 
If an activity potentially allows a child to insert personal information in their created content, we will either pre-screen the submission to delete any personal information, or we will seek verifiable parental consent by email for the collection. 
If OWN plans to post the content publicly or share it with a third party for the third party’s own use, we will obtain a higher level of parental consent.
